Terms of Service for the e-Wallet Cards of Bank of China Limited, Macau Branch(Expired)

1. Definitions

1.1 "e-Wallet Card" means a smartcard stored with a prepaid monetary value and issued by Bank of China Limited, Macau Branch (hereinafter referred to as "the Bank"), which provides such card with consumption, add-value and enquiry functions. There are two types of e-Wallet Cards, namely registered and unregistered. Unless otherwise specified, any reference to e-Wallet Cards below shall mean both the registered and unregistered types.

1.2 "Multi-Currency e-Wallet Card" means an e-Wallet Card which can be used for two or more currencies and which has been enabled with two or more e-wallet functions.

1.3 "China UnionPay Co., Ltd." or "UnionPay" means the Chinese bankcard association established under the approval of the People's Bank of China, having its corporate domicile located in Shanghai, China. UnionPay is a joint-stock financial services institution jointly sponsored and founded by more than 80 Chinese domestic financial institutions.

1.4 "Applicant" means a person who applies to the Bank for the issuance of an e-Wallet Card. If the card is a registered one, the Applicant will be the Cardholder.

1.5"Cardholder" means a person who holds an e-Wallet Card issued by the Bank.

1.6 "Merchant" means any network organization authorized by the Bank to accept payments made by Cardholders on the strength of their e-Wallet Cards for goods and/or services.

1.7 "Account" means any account opened with the Bank.

1.8 "Business Day" means any day on which the Bank is open for business (with the exception of the Hotel Lisboa Sub-branch).

1.9 "Co-branded Organization" means any organization which works in cooperation with the Bank to issue Co-branded e-Wallet Cards.

1.10 "Co-branded e-Wallet Card" means a smartcard which is jointly issued by the Bank and a Co-branded Organization and is equipped with e-Wallet Card features and certain other functions (e.g. door access control and membership identification). These Terms of Service only govern the functions afforded by e-Wallet Cards. Unless otherwise specified, if any specific function provided by a Co-branded Organization is involved, the relevant requirements of the Co-branded Organization must be observed.

1.11 "Imprest Account" means a virtual account maintained in the Bank's back-end system in respect of each e-Wallet Card, and such account is used in certain special circumstances for temporarily holding funds which cannot be credited immediately.

2. Types of e-Wallet Cards and Procedures for Application

2.1 e-Wallet Cards are divided into registered cards and unregistered cards. All e-Wallet Cards, whether registered or unregistered, shall be the property of the Bank. 

2.2 The Bank shall have the right to collect an administrative charge for processing the application for an e-Wallet Card by any Applicant. Once collected, administrative charges are not refundable.

2.3 With respect to a registered card

2.3.1 It means an e-Wallet Card issued by the Bank to an Applicant, whose name and personal data have been loaded onto the card.

2.3.2 An Applicant can apply for the card through any of the business outlets of the Bank or through a designated Co-branded Organization. At the time of application, the Applicant must fill in relevant information on the application documents, sign to confirm, and provide relevant identification documents.

2.3.3 The Bank will retain and will not return the relevant information, regardless of whether the application is successful. The Applicant warrants to the Bank that all information furnished in relation to the applicant shall be true, complete, legitimate and valid, and undertakes to inform the Bank in writing within a reasonable time should there be any change to the information so furnished.

2.4 An unregistered card means an e-Wallet Card applied for by an Applicant through any of the business outlets of the Bank or through a designated Co-branded Organization, and held by the Applicant/Cardholder. The Applicant is not required to provide personal data to the Bank at the time of application.

2.5 If the Applicant is an incapacitated, interdicted or quasi-interdicted person, the application for or renewal of the e-Wallet Card shall be handled by his legal agent or, if any, his curator or guardian (hereinafter referred to as "the Agent") on behalf of such person. If the application concerns a registered e-Wallet Card, valid identification documents of the Agent and the Applicant, and other supporting papers required by the Bank shall also be provided. The Agents shall be responsible for the card usage behaviour of and transactions carried out by Cardholders belonging to this category of persons. 

3.Usage and Enquiry

3.1 Scope of Use

3.1.1 Cardholders will be able to carry out consumption or transactions for goods or services by using the touch or non-touch mode (priority is given to the non-touch mode) of their e-Wallet Cards at any Merchant that carries the "QuickPass" logo of UnionPay. There is no need for the Cardholders to enter any passwords or sign any slips, while the corresponding amounts will be automatically deducted from the stored value of the cards.

3.1.2 Whenever a Cardholder carries out any consumption or transaction in Macau or Hong Kong, the corresponding amount will be automatically deducted from the stored value of the "Macau Pataca Wallet", regardless of the pricing currency of such consumption or transaction. If a Cardholder with a Multi-Currency e-Wallet Card carries out any consumption or transaction on the mainland of the People's Republic of China, the corresponding amount will be automatically deducted from the stored value of the "Renminbi Wallet" of the e-Wallet Card.

3.1.2.1Settlement currency. Transactions via the e-Wallet Card shall be settled in either Macau Pataca or Renminbi.

3.1.2.2 Exchange rate conversion. Any consumption or transaction in a currency other than Macau Pataca or Renminbi shall be converted to Macau Pataca with reference to the exchange rate for settlement set by UnionPay on the date of the transaction. The corresponding amount shall be automatically deducted from the stored value of the "Macau Pataca Wallet" of the e-Wallet Card.

3.1.3 A Cardholder should make sure that his e-Wallet Card is not expired and has sufficient stored value before he carries out any transaction with the card; otherwise he should have it replaced with a new one or should add value to it. The upper limit of the e-Wallet Card stored value shall be the mount prescribed in the latest announcements of the Bank.

3.1.4 The e-Wallet Card cannot be used for withdrawing money from any of the business outlets of the Bank.

3.2 Enquiry Cardholders may use their e-Wallet Cards to check the stored value and transaction details of the cards (subject to delays depending on the circumstances under which such enquiries are processed) at any of the business outlets of the Bank, at any self-service devices of the Bank, or through any channels or equipment made available by the Bank from time to time.

4.Add Value Service

4.1Cardholders may add value to their e-Wallet Cards by the following means at any of the business outlets of the Bank, at any self-service devices of the Bank, or through any channels or equipment made available by the Bank from time to time, and shall confirm whether the stored value is correct right after any add value transaction:

4.1.1 At the counter. Cardholders need to bring along their passbooks or BOC Tri-Currency Debit Cards issued by the Bank, together with their e-Wallet Cards, to any of the business outlets of the Bank in order to add value to the e-Wallet Cards at the counter by means of cash or direct transfer.

4.1.2 Self-service. Cardholders need to bring along their e-Wallet Cards (or their e-Wallet Cards and BOC Tri-Currency Debit Cards issued by the Bank) to the cash deposit machines (or BOC Express) of any 24-hour service centres of the Bank, or other channels or equipment made available by the Bank from time to time, in order to add value to the e-Wallet Cards by means of cash (or through the BOC Tri-Currency Debit Cards) by the Cardholders themselves.

4.1.3 Designated accounts (only applicable to registered e-Wallet Cards).  Cardholders need to bring along their BOC Tri-Currency Debit Cards and registered e-Wallet Cards issued by the Bank, to any of the business outlets of the Bank to apply for the setting up of designated accounts with the Bank. With the designated account relationship in place, the Cardholders may add value to their e-Wallet Cards through the self-service devices and other channels or equipment made available by the Bank from time to time, without the need to provide the BOC Tri-Currency Debit Cards.

4.1.4 Imprest funds (if applicable). If due to the replacement of an e-Wallet Card or due to other reasons, there is a positive balance in the Imprest Account maintained with the Bank with respect to such e-Wallet Card of a Cardholder, then the Cardholder may make use of any self-service devices of the Bank or other channels or equipment made available by the Bank from time to time to add value to his e-Wallet Card by using the imprest funds, without the need to provide any password.

4.1.5 Others. Cardholders may also add value to their e-Wallet Cards at any Merchants designated by the Bank from time to time to provide add value service, or through any means specified by Bank.

4.2 If a Cardholder adds value to his e-Wallet Card in a currency other than Macau Pataca or Renminbi, the corresponding amount will be converted into either Macau Pataca or Renminbi before it is credited to the wallet of the currency so converted. (This process is applicable to Multi-Currency e-Wallet Cards containing both the "Macau Wallets" and the "Renminbi Wallets").

4.3 The upper limit of any value added to the e-Wallet Cards shall be subject to the announcements made by the Bank from time to time. The Bank reserves the right to charge a fee for the add value service and may adjust the same from time to time.

5.e-Wallet Cards Shall Not Be Transferred, Loaned or Leased

e-Wallet Cards shall not be transferred, loaned or leased to others. In addition, holders of registered cards shall prevent any third party from knowing the relevant information of the cards, otherwise all risks of loss and legal liability which may arise shall be borne by the Cardholders.

6.Safekeeping, Loss, Theft or Other Loss of Possession

6.1 e-Wallet Cards are property of the Bank. Cardholders are advised to exercise care in the use and safekeeping of the cards, so as to prevent any loss, theft, fraud or destruction of the cards, or the Cards' possession from being taken by third parties.

6.2 In the event of any loss, theft or other loss of possession of the e-Wallet Cards, the stored value inside the cards shall be deemed to have lost, been stolen or been taken possession of by others as if cash, and the Bank shall be under no obligation whatsoever to refund or compensate therefor.

6.3 Cardholders shall bear any liability arising from the loss or improper safekeeping or use of the e-Wallet Cards.

7. Loss Report, Replacement, Cancellation and Remaining Value

7.1 If a registered e-Wallet Card is lost, stolen or otherwise taken possession of by others, the Cardholder shall give notice to the Bank as soon as possible for the handling of the loss report procedures. Upon completion of the loss report procedures, any imprest funds standing in the records of the Bank as at the time of the loss report will be refunded to the Cardholder. The Cardholder may also apply to terminate any designated account relationship established with the Bank for the add value service (if applicable). Loss report procedures are not applicable to unregistered e-Wallet Cards.

7.2If any functionality of an e-Wallet Card is lost due to demagnetization, damage, malfunctioning or any other reasons, the Cardholder shall go in person to any of the business outlets of the Bank to apply for a replacement and to return the old card. If the application is accepted, the Bank will issue a new card to the Cardholder and will transfer the remaining value and imprest funds (if any) of the old card to the imprest funds of the new card after a period specified by the Bank from time to time. The Bank reserves the right to charge a fee for the replacement service and to adjust the same from time to time (see the fees and charges table for reference).

7.3 An e-Wallet Card is valid for ten (10) years (from the ex-factory date). All functions of the e-Wallet Card will automatically lapse upon the expiry of the validity period. The Cardholder shall go in person to any of the business outlets of the Bank to apply for a renewal and to return the old card. If the application is accepted, the remaining value and imprest funds (if any) of the old card will be transferred to the imprest funds of the new card after a period specified by the Bank from time to time.

7.4 If a Cardholder ceases to use his e-Wallet Card, he shall go in person to any of the business outlets of the Bank to apply for a cancellation service and to return the card. If the application is accepted, the Bank will refund the remaining value of the e-Wallet Card.

7.5 None of the above loss report, replacement or renewal procedures or cancellation service is applicable to Co-branded e-Wallet Cards. Reference should be made to the relevant regulations of the Co-branded Organizations concerning the loss report, replacement or renewal procedures or cancellation service of Co-branded e-Wallet Cards.

7.6 The Bank shall be under no obligation whatsoever as to any temporary unavailability for use of any e-Wallet Cards due to objective reasons such as any force majeure event, power supply and communications, as well as any change to laws and regulations, regulatory requirements, relevant policies or industry standards.

8.Handling and Disclosure of Data

8.1 The Bank and designated Co-branded Organizations shall deal with and keep the personal data provided by the Applicants in accordance with the provisions of the Personal Data Protection Ordinance (Act 8/2005).

8.2 Concerning matters such as the application, use, operation and the provision of services of e-Wallets Cards and other specific functions, the Applicants are aware that the Bank may, and the Applicants hereby authorize the Bank to, disclose data provided by the Applicants to any agents, sub-contractors or others appointed or employed by the Bank

9. Termination Event

If a Cardholder is involved in any of the following situations or commits other violations of the terms hereof, the Bank may thereby suspend/terminate and recover the e-Wallet Card used by the Cardholder:

9.1 The Cardholder uses his e-Wallet Card to carry out illegal consumption or transactions for goods or services at any Merchant.

9.2 The Cardholder acts with any third party or any shop to fabricate fictitious and false transactions, or to collude to commit fraud, convert money in any way, raise funds or obtain illegal advantage.

9.3 The Cardholder does not comply with these terms or he commits other illegal or illicit behaviour.

10. Other Provisions

10.1 The stored value and imprest funds of an e-Wallet Card are not bank deposit and do not accrue deposit interest.

10.2 The Bank shall have the right to amend these terms and adjust the fee schedule and standards. Any amendments/adjustments shall be deemed to be effective and binding on the Cardholder if the Bank gives notice to the Cardholder about such amendments/adjustments in any of the following ways:

10.2.1 a notice is posted in the main lobby of the Bank for three (3) Business Days;

10.2.2 a notice is published in a Macau newspaper for three (3) Business Days; or

10.2.3 a notice is posted on the website of the Bank.

10.3 The Bank shall have the right to deduct relevant fees from the e-Wallet Card pursuant to the fee standards formulated by the Bank. (See the Fees and Charges Table.) If the Cardholder does not pay such fees, the Bank shall have the right to terminate the relevant services.

10.4 The application for (whether with signature as confirmation or not) and the use of an e-Wallet Card mean that the Applicant and/or Cardholder have acknowledged to perform and have agreed to comply with these terms and all the rules of the Bank concerning e-Wallet Cards, and that the Applicant and/or Cardholder are deemed to have agreed to the various fees and standards. As to the application for and use of a Co-branded e-Wallet Card, the Applicant and/or Cardholder have acknowledged to perform and have agreed to comply with all the terms and requirements set by the Co-branded Organization(s) with respect to such e-Wallet Card or its specific functions.

10.5 All transactions shall be deemed to be the deed of the Cardholders. The Bank does not entertain any dispute which may arise from the transactions with e-Wallet Cards. Any dispute between the Cardholders and Merchants concerning their transactions shall be settled by the Cardholders and Merchants themselves. In no event shall disputes between Cardholders and Merchants be any reason for the Cardholders to demand the Bank to refund the considerations paid for goods or services with e-Wallet Cards. If a Merchant refuses to accept payment by a Cardholder with his e-Wallet Card for goods or services, the Bank shall not be liable for any loss to the Cardholder arising therefrom.

10.6 When Cardholders add value to their e-Wallet Cards at the Bank, return their e-Wallet Cards to the Bank, or add value or carry out consumption by means of the Bank's self-service devices or transaction terminals (if applicable), they shall comply with all laws, regulations, regulatory requirements and relevant policies of Macau, as well as the relevant rules of the Bank, UnionPay and the acquiring institutions (if applicable).

10.7 In case there is any change to the personal data such as the personal address, telephone number(s) or valid identification documents of the Cardholder or contact person of a registered e-Wallet Card, the Cardholder shall immediately go to any of the business outlets of the Bank or to the relevant Co-branded Organization so as to handle the procedures for the change of data, otherwise all risks and loss arising therefrom shall be borne by the Cardholder.

10.8 The Bank shall be under no obligation whatsoever as to any temporary unavailability for use of any e-Wallet Card due to objective reasons such as any force majeure event, power supply and communications, as well as any change to laws and regulations, regulatory requirements, relevant policies or industry standards.

11.Matters to Note

11.1 Cardholders shall not make any unauthorized modification, interference, change or physical damage to the e-Wallet Cards, surface design, the chips on the cards and their integral parts such as electronic components, and/or the software and data stored in the cards. Furthermore, Cardholders shall reasonably ensure that such design and data are not subject to any third party interference. Any unauthorized modification to the data contained in the e-Wallet Cards may constitute a criminal offence.

11.2 If there is any unauthorized modification or man-made damage to the e-Wallet Card of a Cardholder, the Bank will not recognize any consumption transaction or stored value of the card, nor will the Bank accept any application for the replacement of the card. The Bank shall have the right to claim all reasonable costs and compensation from and against the Cardholder should the Bank suffer any costs, expenses, loss or damage caused thereby.

11.3 A Cardholder shall prevent his e-Wallet Card from being:

11.3.1folded, altered or scratched;

11.3.2 placed close to coins in the wallet, or put near buttons, zips or magnets;

11.3.3 kept in places with high humidity or temperature (e.g. inside an airtight and hot interior of a vehicle);

11.3.4put in the back pocket or else the chip on the card may be damaged when the Cardholder sits down; and

11.3.5applied to a card reader together with other contactless smartcards or electronic products.

12.Miscellaneous

12.1 Transactions under these terms are carried out based on the independent interests of the respective parties. If any Cardholder is deemed to be an affiliate or affiliated person of the Bank pursuant to any law, regulation or regulatory rule, no party shall seek to take advantage of this relationship to affect the fairness of any transaction.

12.2 These terms have been formulated and shall be interpreted by Bank of China, Macau Branch.

12.3 The Bank reserves the right to amend the terms herein from time to time without prior notice to Cardholders, regardless whether they are aware of the amendments, which shall be effective with respect to and binding on the Cardholders.

12.4 These terms shall formally come into effect on the date of their announcement.
